Terms and Conditions of Use

The terms and conditions described here, hereinafter referred to as the “Terms,” include the “Terms and Conditions of Use” of the Rais Blog site, which govern the use of the system, which is made up of services whose brand is managed by BACKSTAY TECHNOLOGY LTDA, registered under CNPJ (Brazilian company tax ID) No. 68.588.840/0001-50. Users are the people and health professionals who register in the system and accept these Terms.

General terms:

  1. By accessing the site, using our services or registering in our system, you agree to the “Terms” described here. If you do not agree with the current version of the terms, you are not authorized to use the services or to access the websites and services of the RAIS brand. Your authorization to use them depends on your acceptance of the terms.
  2. We may revise these Terms from time to time. The most current version will be available on our system (www.raisdata.com). The revised Terms take effect on the date they are published on the system. By continuing to access the system after such revisions take effect, you agree to and accept compliance with the revised Terms.
  3. Our system is a publishing platform for health content, where professionals and other interested parties publish texts and other forms of information (such as videos) under their own responsibility. We at RAIS provide the infrastructure for publishing this material.
  4. The RAIS system provides access to sites and services free of charge. However, Backstay reserves the right to charge for access to the site or for the use of any of the services, whenever it sees fit, for current and/or additional services, with prior notice to users and giving them the option to accept or decline the charge, subject to the terms that apply to declining. The RAIS site also reserves the right to display ads on the text pages published by any user, or on any other pages it deems necessary, and such ads are therefore not tied to the content of any user.
  5. Some sections of the RAIS system contain material intended for adults only, recommended for people who are at least 18 (eighteen) years old. When a user accesses adult content, we will presume that the user is at least 18 (eighteen) years old and that the material is appropriate for their age.
  6. The system is not intended to diagnose or to replace the assessment of a physician, pharmacist, nutritionist, physical education professional, or any other professional who may use the information we store. For any intervention of any kind affecting your current condition as an individual (such as diet, treatment of diseases, or proposed physical activities, among others), a professional in the relevant field must be consulted. The information and reports presented here serve only as informational support for the community.
  7. The form and nature of the system may be changed without any prior notice, as may the total or temporary suspension of the services provided.
  8. The company also reserves the right to suspend the use of the system by a given user or group of users, or to limit the amount of data stored, with prior notice to the user. The company also has the right to refuse subscriptions or to delete information or users entirely from the system. Accounts that have been inactive for more than 6 months may also be deleted automatically by the system.

The User:

  1. The information stored in the system, its accuracy and its currency are entirely the user’s responsibility, and the user confirms this responsibility by accepting the terms of use. The system will only use the information provided by the user to generate reports and analyses intended to support the current health picture of a location, region, country and others, in accordance with our “Privacy policy” and these terms. The user will always be the party responsible for, and the owner of, the data in the information published. By using the system, the user agrees to our privacy policy.
  2. The user retains full responsibility for saving and using their personal passwords. The RAIS team recommends using strong passwords (for example, a mix of uppercase and lowercase letters, numbers and letters, and avoiding full names, birth dates or other numbers that third parties could easily guess). We are not liable for any damage caused by failure to comply with what is described in this item.
  3. Keeping personal information up to date in the system is also entirely the user’s responsibility. In the specific case of a change of email address, the user must inform the RAIS team so that the database can be updated.
  4. There are limitations on the use of the system, in accordance with legal requirements, in order to preserve the integrity of our users, improve the quality of the services provided and offer users a better experience. Any abuse will be penalized, and the accounts involved may be deleted temporarily or permanently. If other accounts are created to circumvent a previous deletion, those new accounts may also be deleted.
    • Lawful use: The information provided may only be used for lawful purposes. In the event of unlawful use, users are subject to the criteria and laws of the country or region where they are located.
    • Restricted access: By accessing the system, you are prohibited from performing any of the following actions: (i) accessing and/or altering areas and data other than your own account, such as servers, the site’s source code, the system’s computers, and other non-public locations; (ii) breaking into the system, searching for vulnerabilities, or breaking authentication and security measures; (iii) using any means other than the public ones (whether automated or not) to access and/or alter the system; (iv) attempting to interfere with or interrupt any access by any user, host or network.
    • Third-Party Data: Users must not disclose, in any form or for any reason (intentional or due to a system failure), any data of any kind belonging to third parties, that is, other users, without those users’ express permission.
    • Content: No content intended to harm the system or another user (such as malware, viruses, etc.) may be submitted. All submitted content is the sole responsibility of its author (the user).
    • Users are permitted to access the system only if they are under contract with Backstay and are not barred from accessing the system under the applicable law of the place where they are located. Users agree to access the system solely in accordance with these Terms and all applicable rules and regulations. The system is not directed to any person for whom (because of that person's nationality, place of residence or otherwise) the publication or availability of the system is prohibited. Persons subject to such restrictions must not access the system. If you choose to access the system, you are presumed to be in compliance with local laws.

  1. Backstay and its licensors reserve all rights in the system, including copyright, trademarks, logos, intellectual property, databases, the overall design of the site, the domain name, usability, and any other information of interest to the group (except personal data). Some of these elements are protected by the trademark and intellectual property laws of each country. Nothing in these Terms grants the user the right to use any of these items. The content of this site may not be used by the user for commercial purposes under any circumstances. The user's rights are limited to personal use, such as printing. In the event of a breach of this clause, Backstay reserves the right to seek compensation for financial losses and for special, incidental, consequential or indirect damages, among other damages established in proceedings.
  2. Copying, selling, reproducing, commercializing or otherwise using the system (user interface, graphics, features, information, brand, logo, among others) is prohibited, as is using this information or the system for one's own commercial purposes. The content of the system must not be copied, reformatted, redistributed, plagiarized or used in any way without the written consent of the RAIS team.

  1. RAIS also reserves the right to access, read, retain and disclose any information or data where necessary to (i) comply with any applicable law, regulation, legal process or governmental request, (ii) enforce these Terms, including investigating potential violations of them, (iii) detect, prevent or address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of RAIS, its users and the public.
  2. Backstay reserves the right to examine and verify the activities of any user of the system or of any other service and/or activity promoted by the group, and to temporarily or permanently remove the user from the system, or suspend or delete their account, if we reasonably believe such measures are necessary to (i) comply with any applicable law, regulation, legal process or governmental request, (ii) enforce these Terms, including investigating a potential violation of them, or (iii) protect the rights, property or safety of Backstay, its users and the public.
  3. Backstay is not responsible for the use against the user of any information, opinion or fact disclosed by the user, even of a personal nature, while using the forum or email service, nor for any loss, damage, embarrassment, suffering or any other problem that may be caused by that fact.
  4. Backstay has no liability in any other situations not provided for in these terms and conditions of use, or in cases not covered by them, and reserves the right to decide such cases at its sole discretion.

Backstay will not be liable for information in links to external objects under any circumstances.
  3. The RAIS System promotes, free of charge, third-party sites selected by our team, through links (pointers, communication channels). If the persons responsible for a selected site do not wish to be connected to RAIS through links, please contact our support team.
  4. The RAIS System publishes information and opinions from many people, organizations, associations and entities, whether philanthropic, commercial, ideological, academic, religious or on any other subject, as a democratic channel on the internet. For this reason it is not responsible for the content of those opinions and information, which are characterized as third-party information.

Each of the activities above may also have its own specific rules, such as prizes and tiebreaker criteria, among others.
  2. Backstay reserves the right to communicate with the user through the registered email address or any other contact method provided by the user.

Other terms:

  1. Backstay provides the system's content and any information in good faith, but access to and use of it is at the user's own risk. In that case, neither Backstay nor any of its directors, officers, employees, agents, partners, affiliates and licensors may be held liable for any omissions or errors in the Information, or for any loss or damage that may subsequently arise.
